1. Sites encouraging illegal activity, hate or racism, sites having threatening content or other sites we deem inappropriate are not permitted to become a member of the Program.

2. The information about registered web sites (name, URL, card counts, etc.) become the property of NetGiftEcards.com and Merimax, Inc. All members agree to utilize the services of NetGiftEcards.com and Merimax, Inc. at their own risk. NetGiftEcards.com and Merimax, Inc., its administrators, developers and sponsor cannot be held liable for any damage or loss of information that may occur from the use of this service. Although we always try to provide a high standard of quality for NetGiftEcards.com and Merimax, Inc., we cannot make any guarantees concerning the permanent availability, faultless functioning, or timeliness of our services nor do we acknowledge any responsibility. Members also agree that cards created through this program can be directed to NetGiftEcards.com and Merimax, Inc. at any time if any problem occurs.

3. Enrollment in the program automatically enrolls you in the NetGift.com Affiliate program. This will allow you to generate income from NetGift.com advertising on the Free Ecard site. By accepting these terms and conditions you also accept the terms and conditions of the NetGift.com affiliate Program. If you would like to earn income from sales generated by other advertising on the free eCards site you will need to signup for the participating affiliate programs. Information about how to signup for other programs used in advertising on the site will be sent to you upon signup. Signing up for other affiliate programs featured on the Ecards website is optional but if you choose not to signup for the programs, revenue generated from the advertising will default to Merimax, Inc. NetGift and Merimax, Inc. only deal with reputable and stable affiliate programs but NetGift and Merimax, Inc. are not responsible for any problems that may result between you and any other affiliate programs advertised on your free eCard site.

4. The information provided by NetGiftEcards.com and Merimax, Inc. to members (e.g. statistics) may be of proprietary nature. Members acknowledge that they are not competitors of the NetGiftEcards.com eCard Service and agree not to make this information available to third parties. Members agree that information collected by NetGiftEcards.com and Merimax, Inc. will be used by NetGiftEcards.com and Merimax, Inc. for its own use, and may or may not be disclosed to members. A member may cancel his/her membership at any time.

5. Members acknowledge that the NetGiftEcards.com Free eCard Service is a free service. They provide this service to their visitors for free. Members are not permitted to sell cards created through the NetGiftEcards.com system.

6. NetGiftEcards.com and Merimax, Inc. owns and reserves all right to its software, products, services and any other relevant information arising out of its service.

7. Members agree to defend, indemnify and hold harmless NetGiftEcards.com and Merimax, Inc., its affiliates and their employees and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of NetGiftEcards.com eCard service by Members or Members' Accounts.

8.Members not conforming to any of the above rules will will have their accounts terminated without notice.

9. NetGiftEcards.com and Merimax, Inc. reserve the right to alter or change these Terms and Conditions at any time and without notice.

10. NetGiftEcards.com and Merimax, Inc. reserve the right to terminate your account at any time and without notice.
